For these Terms and Conditions, the “Promoter” refers to Master Scuba Divers Co. Ltd., 25/8 Moo2, Mae Haad, Koh Tao, Suratthani, 84360, Thailand, whose Instagram handle is @masterdiverskohtao. The “Giveaway” refers to various giveaways, sweepstakes, and/or contests posted on Instagram and shared on other social media platforms. The Giveaway does not refer to the Master Divers Life contest or other similar contests that require participants to submit entries directly to the Promoter. The “Prize” refers to the prize details stated in the relevant Giveaway post on Instagram (the “Giveaway Post”).
By entering a Giveaway, you (the “Entrant”) agree to be bound by these Terms and Conditions. All entries must be received by the time stated in the Giveaway Post (the “Deadline”). One (1) Winner (unless otherwise stated in the Giveaway Post) will be selected by The Promoter following the Deadline, or at such time as stated in the Giveaway Post, and the Winner will be notified on or after such time.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
Entrants must be over 18 years old on the date of their entry.
Employees of the Promoter are not eligible to enter.
Instagram, Facebook, and any other social media platform (together the “Social Media Platforms”) on which the Giveaway Post is shared are not in any way affiliated with or involved in the Giveaway. The Promoter and each Entrant agree to release and hold harmless the Social Media Platforms from any liability associated with the Giveaway.
Unless otherwise stated in the Giveaway Post, only one entry per person per Giveaway will be accepted.
Each entrant shall enter the Giveaway via Instagram by following the Instagram profile of the Promoter and completing any additional requirements as stated in the Giveaway Post. Winners are required to be following the Instagram profile of the Promoter at the time they are selected.
Unless otherwise stated in the Giveaway Post, the Prize will be awarded to a randomly selected Winner who has entered on Instagram and completed the requirements as stated in the Giveaway Post.
Unless otherwise stated in the Giveaway Post, the Winner must claim their Prize at the physical location of the Promoter in Koh Tao, Thailand, as stated above. The Promoter will not ship or deliver any Prize and the Promoter will not provide any allowance or compensation to the Winner in regard to costs related to claiming the Prize.
The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete, or otherwise invalid.
To the extent permitted by applicable law, The Promoter’s liability under or in connection with the Giveaway or these Terms and Conditions shall be limited to the cost of the Prize in question.
To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these Terms and Conditions, the Giveaway, or any Prize for any indirect, special, or consequential cost, expense, loss, or damage suffered by an Entrant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the Entrant and the Promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty, or otherwise.
Each Entrant understands and agrees that the Promoter, anyone acting on behalf of the Promoter, the Promoter’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your name, picture, likeness, image, Giveaway entry and any information and media contained therein, and any statements about the Giveaway, for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.
Prizes are non-negotiable, non-transferable, and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the Promoter reserves the right to substitute that Prize for a prize of equal or higher value. The Promoter will not be held liable if the named Prize becomes unavailable or cannot be fulfilled.
The Winner’s name, email address, phone number, and birthdate must be provided to The Promoter, if requested, and may be shared with third parties, where required, to enable fulfillment of the Prize. Failure to provide such, if requested, in a timely fashion will result in nullification of the Winner’s selection and an alternate Winner will be selected, at the Promoter’s discretion.
In the event of unforeseen circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify, or suspend the Giveaway or these Terms and Conditions, either in whole or in part, with or without notice.
Any and all decisions made by the Promoter are final. No correspondence will be entered into.
The Winner’s name and social media username may be posted on the social media profiles of the Promotor after the Winner has been selected.
